BEFORE: MERRITT, BROWN and KENNEDY, Circuit Judges Order Upon consideration of defendant's motion to dismiss this appeal for lack of jurisdiction, the Court finds that the district court order entered on February 6, 1981, is interlocutory and non-appealable. It adjudicated one or more but fewer than all of the claims raised by plaintiff and the district court did not certify it as a final order pursuant to Rule 54(b), Federal Rules of Civil Procedure. In addition, plaintiff did not seek certification under 28 U.S.C. Ãƒâ€šÃ‚Â§ 1292(b). This lack of certification deprives the Court of jurisdiction. Oak Construction Company v. Huron Cement Co., 475 F.2d 1220 (6th Cir. 1973). Accordingly, It is ORDERED that the motion to dismiss be, and it hereby is, granted. Rule 8(a), Rules of the Sixth Circuit.
